ACFF Terms and Conditions

1 A SME will register with ACFF before the listIng of its funding advertisement on this website.

2 An Investor will register with ACFF before receiving documents relating to an advertisement that it has requested (in writing) from ACFF

3 A SME will pay ACFF a fee of 3% of the nominal value of funds received or to be received, by it from one or more Investors. The SME will pay this fee to ACFF by BACS on the same date as investors' funds are received by it. Failure by the SME to pay the fee on the due date will incur late payment interest of BoE Base + 3% charged by ACFF to the SME per day on the overdue amount until they are received by ACFF.

4 The SME and Investor agrees it will not act in a way that avoids payment by the SME of the above fee

5 The SME and Investor agree they will at all times act in good faith, including informing ACFF immediately of a) any agreement they enter into whereby the Investor agrees to invest in the SME, and b) the nominal amount and date such funds will be invested.

6 The SME agrees it will provide information to ACFF regarding its funding advertisement, and to provide ACFF with updated information from time to time as necessary,so that the advertisement seen by potential Investors is true and complete in all material respects at all times.

7 Neither the SME nor any Investor will hold ACFF liable for any loss arising as a consequence of an advertisement, for the information contained in it, or for any delay in updating it.

8 ACFF may make checks and investigations it considers reasonable, to confirm the identity of the SME or Investor, and their representatives, in relation to an advertisment.

9 ACFF may refuse to list, or may delist, any advertisement without reason, and may discontinue the website at any time, without reason. ACFF will notify the SME of a delisting.

10 ACFF may refuse any request for information by an Investor relating to an advertisement, and without reason.

11 ACFF may change these terms and conditions from time to time without notice.
